Car Crash Lawyers Assisting New Hampshire Victims

Unlike some states, New Hampshire does not require drivers to carry automobile insurance. In cases in which an accident is caused by a negligent driver who is not insured, it can be difficult for the injured person to recover the full amount of damages caused by the accident from the driver. If you are injured in an Uber accident, however, depending on the circumstances surrounding your accident, you may be able to recover compensation under Uber’s automobile insurance policy for its drivers, regardless of whether the driver has personal insurance. You should consult a seasoned New Hampshire Uber accident lawyer to assist you in determining which damages you may be able to recover through Uber insurance. The attorneys at Peter Thompson and Associates collectively have over six decades of experience assisting New Hampshire residents in their pursuit of compensation following a car accident. We will work diligently to formulate strong arguments in your favor to help you fight for a successful outcome under the circumstances.

Uber Insurance Coverage for Drivers

Uber provides insurance for Uber drivers involved in accidents, but the coverage varies based on the driver’s activities. If an Uber driver is operating his or her vehicle solely for personal use at the time of the accident, no coverage is provided. If a driver is operating his or her vehicle as an Uber driver when the accident occurs, the level of coverage provided depends on whether there is a paying passenger in the car. The first tier of coverage applies when an Uber driver has the Uber app on and is waiting for a ride request. The first tier provides liability coverage to the Uber driver at a minimum of $50,000 per person and $100,000 per accident for any bodily injuries caused by the Uber driver, in addition to $25,000 per accident for property damage.

The second tier of coverage applies when a driver is on the way to pick up a ride and during a trip. The second tier of coverage provides liability coverage of at least $1,000,000 per accident for any property damage or bodily injuries caused by the Uber driver. In addition to liability coverage, the second tier provides uninsured and underinsured motorist bodily injury coverage, which covers passengers in the Uber driver’s vehicle when another driver is at fault for the accident but has inadequate insurance. This coverage also covers damages caused by hit and run drivers who leave the scene. The coverage limits for uninsured and underinsured coverage are also at least $1,000,000 per accident.

Proving That Uber Insurance Coverage Applies

Even if an Uber driver is covered under Uber’s insurance at the time of an accident, liability coverage will not apply unless the person injured in the accident can prove that the accident was caused by the Uber driver. In most New Hampshire car accident cases, the party seeking to recover damages will assert that the negligence of the defendant driver caused the accident. To prove that a driver was negligent, you must show that the driver owed you a duty of care and that the driver breached the duty. You must also demonstrate that the breach caused the accident and that you suffered harm due to the accident.

It is common for an allegedly negligent driver to argue that the injured person’s negligence caused the accident. A finding that you were partially at fault for the accident will not preclude your recovery, however, as long as your fault does not exceed the defendant’s fault. If any fault is attributed to you, your damages will be reduced in proportion to your percentage of fault. Seeking damages through an Uber insurance policy following an accident with an Uber driver can be complicated. If you were involved in an accident with an Uber driver, you should retain an experienced New Hampshire attorney to formulate a plan for seeking compensation for your harm.
